Agreement to These Terms
These Terms of Service (the "Terms") govern your use of this website and the services provided by Nelson Painting, Inc. ("we," "us," or "our"). By using this website, requesting an estimate, scheduling work, exchanging text messages with us, or accepting our services, you agree to these Terms.
If we provide you with a separate written proposal, estimate, work order, or service agreement for a specific job, that document governs the details of that job. Where it conflicts with these Terms, the signed job document controls for that job.
If you do not agree to these Terms, please do not use this website or our services.

Services We Provide
We provide the services described on this website. Descriptions, photographs, and service areas shown here are for general information and are not an offer or a guarantee that a particular service is available at your property. Availability depends on location, scheduling, site conditions, and applicable licensing and permitting requirements. The scope of any job is the scope set out in your written estimate or work order.
Estimates, Quotes, and Pricing
Estimates are based on the conditions visible and the information available at the time they are prepared. Unless the document says otherwise, an estimate is valid for 30 days and is not a fixed-price contract.
If we discover conditions that could not reasonably have been seen beforehand — for example concealed damage, unmarked utilities, rot, pests, code issues, or ground conditions that differ from what was visible — we will stop, tell you, and provide a revised price for your approval before continuing. You are not charged for additional work you have not approved.
Prices shown anywhere on this website are estimates for general guidance only and are not binding quotes.
Scheduling, Property Access, and Cancellations
We will agree on a service date or arrival window with you in advance. Work may be rescheduled for weather, safety, permitting, material availability, or circumstances outside our reasonable control. We will let you know as soon as we can when that happens.
You agree to provide safe and reasonable access to the work area on the scheduled date, including access to utilities where the job requires them, and to secure pets and remove or protect fragile or valuable items from the work area.
If you need to cancel or reschedule, please give us as much notice as you can. If we arrive as scheduled and cannot access the property or begin work through no fault of ours, we may charge a trip or rescheduling fee, and any deposit may be applied to it.
Payment Terms
Payment terms for a specific job are set out in your estimate, work order, or invoice. A deposit may be required before work begins or before materials are ordered. Unless your invoice says otherwise, the balance is due on completion of the work.
We accept the payment methods listed on your invoice. Payments are handled by third-party payment processors; we do not store full payment card numbers.
Past-due balances may accrue interest or a late fee at the rate stated on your invoice, to the maximum permitted by law. If we have to refer an unpaid balance for collection, you may be responsible for reasonable collection costs and attorneys' fees to the extent permitted by law. We may suspend work on any job while an invoice is past due.
Your Responsibilities
You agree to:
- give us accurate information about the property and the work you are requesting;
- confirm that you own the property or are authorized to approve work on it, and obtain any approval required by a landlord, homeowners association, or co-owner;
- tell us in advance about anything on the property that affects the work — septic systems, irrigation lines, invisible fencing, private utilities, easements, prior damage, or known hazards;
- keep children and pets clear of the work area while we are on site; and
- promptly report any concern with the work so we have a chance to address it.
We mark and locate public utilities as required by law, but we are not responsible for damage to private or unmarked lines that were not disclosed to us.
Workmanship and Warranty
We warrant that our workmanship will be performed in a professional manner consistent with accepted practice in our trade. Any workmanship warranty period applicable to your job is the period stated in your written estimate, work order, or invoice.
Manufactured materials, equipment, and products carry only the warranty offered by their manufacturer. We pass through those warranties to you and will help you make a claim, but we do not extend them.
Any warranty does not cover normal wear, damage from weather or other events outside our control, misuse, neglect, lack of required maintenance, work altered or repaired by someone else, or pre-existing conditions. Warranty service requires that your account be paid in full.
Text Messaging (SMS) Terms
These terms apply to the Nelson Painting, Inc. text messaging program.
What we send
When you give us your mobile number, we may send you text messages about your request or your job: estimate and quote follow-ups, appointment confirmations and arrival windows, scheduling changes, service and crew updates, invoices and payment reminders, and replies to messages you send us. We send promotional or marketing texts only if you have separately asked to receive them.
How you consent
You consent to receive text messages from us when you give us your mobile number on a form, on an estimate or service agreement, over the phone, or by texting us first. Consent to receive text messages is not a condition of purchasing any goods or services.
Message frequency
Message frequency varies. It depends on the work you have scheduled and on any conversation you start with us.
Cost
Message and data rates may apply. Your mobile carrier may charge you for sending and receiving text messages. Check your plan for details.
How to stop messages
Reply STOP to any message from us to opt out at any time. We will send one confirmation message and then stop texting you. To start again, reply START. Opting out of text messages does not opt you out of phone calls or email, and we may still need to contact you another way about work already scheduled at your property.

Carriers and delivery
Message delivery is subject to effective transmission by your mobile carrier and is not guaranteed. Mobile carriers are not liable for delayed or undelivered messages. Not all mobile devices or carriers support every messaging feature.
Your information
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent are never shared with any third party for those purposes. How we handle your information is described in our Privacy Policy.
Email Communications
When you contact us or become a customer, we may send you email about your estimate, appointment, job, or invoice. We may also send occasional marketing email where permitted. You can opt out of marketing email using the unsubscribe link in any marketing message. Service-related email about work you have scheduled will still be sent.
Use of This Website
You may use this website for lawful purposes only. You agree not to use it to attempt to gain unauthorized access to any system, to interfere with its operation, to scrape or harvest data by automated means, to submit false information, to transmit malicious code, or to violate any applicable law.
We may change, suspend, or discontinue any part of this website at any time without notice. We work to keep the information here accurate and current, but we do not warrant that it is complete, error-free, or continuously available.
Intellectual Property
The content on this website — including text, photographs, graphics, logos, and the site design — is owned by Nelson Painting, Inc. or its licensors and is protected by copyright, trademark, and other laws. You may view and print pages for your own personal, non-commercial use. You may not otherwise copy, republish, sell, or use our content or our name and logo without our prior written permission.
Reviews, Photos, and Submissions
If you send us a review, testimonial, photograph, or other content, you confirm that it is yours to share and that it does not infringe anyone's rights. You grant us a non-exclusive, royalty-free license to use, reproduce, and display it in connection with our business, including on this website and in marketing.
We may photograph completed work for our portfolio. Tell us if you would prefer that we not photograph your property, and we will not.
Third-Party Links and Services
This website may link to websites and services we do not operate, including manufacturers, review platforms, social media, financing partners, and payment portals. We provide those links for convenience. We do not control and are not responsible for their content, products, or practices, and your dealings with them are between you and them.
Disclaimers
Except for the workmanship warranty described above and any warranty stated in your written job documents, our services and this website are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing in these Terms limits any right you have under consumer-protection law that cannot be waived.
Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or loss of use, arising out of or relating to this website, our services, or these Terms. To the fullest extent permitted by law, our total liability for any claim relating to a job is limited to the amount you paid us for that job. This section does not limit liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold harmless Nelson Painting, Inc. and its owners, employees, and subcontractors from any claim, loss, or expense (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of this website, your failure to disclose a known condition or hazard at the property, or your lack of authority to approve work at the property.
Dispute Resolution and Governing Law
If you have a problem with our work, contact us first. Most issues are resolved quickly once we know about them, and we ask for the opportunity to inspect and correct the work before any other action is taken.
These Terms are governed by the laws of the State of Massachusetts, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved directly will be brought in the state or federal courts located in Plymouth County, Massachusetts, and you and we consent to the jurisdiction of those courts. Nothing here prevents either party from bringing a claim in small-claims court, or from using any dispute process a consumer-protection law makes available to you.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date shown at the top of this page and post the updated Terms here. Your continued use of this website or our services after an update means you accept the revised Terms. The Terms in effect on the date of your signed estimate or work order govern that job.
